Some Debts Can Be Disputed

As a Debtor, of course there are times when a debt may be legally disputed. You may feel you do not owe the amount that someone is trying to collect from you or your small business because it is not your debt or you already paid it, or that the creditor has no right (standing) to collect it.

The claim may arise out of a dispute over a contract (or the lack of a contract), a medical bill, car loan, promissory note, credit card bill, or it may even be a rent dispute between a Landlord and a Tenant. We can review the facts of such a case and respond to the creditor on your behalf.

Perhaps you acknowledge the amount owed but simply have been unable to pay your debt due to a personal issue, loss of work or the COVID-19 pandemic, and one or more creditors have threatened legal action through a demand letter, or have actually taken legal action to collect by filing a lawsuit or foreclosure action against you. Even if this is the case, it may be possible to renegotiate the amount owed and/or settle on a manageable payment plan that helps avoid litigation, a judgment and negative information appearing on your credit report.

The important thing is to act promptly and not let the situation get worse by ignoring notices or lawsuits you are receiving from a creditor, whether valid or not or a judgment may be filed against you, which you would then have to seek to vacate.
